These Terms & Conditions (“Terms”) govern your use of the website https://aiphotoprompts.in and the official Android application LotaMota AI Prompts (together called “the Service”). By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the website or the app.

1. Who operates the Service

2. Description of the Service
The Service is a free library of ready-made text prompts intended for use with third-party AI image generation tools such as Google Gemini, ChatGPT, and similar platforms. You can browse, search, like, save, share, and copy prompts. Sample images shown with prompts are illustrative examples only.

We do not generate AI images on our servers. We do not guarantee the quality, accuracy, style, or suitability of any image that a third-party AI tool produces when you use one of our prompts. Results depend entirely on the AI platform you choose and the settings you apply there.

The website does not require account registration. The Android app is the official companion application and is available on the Google Play Store.

3. Intellectual property

• The website design, brand name “AI Photo Prompts”, logo, compiled collection of prompts, and overall structure are owned by Saurabh Vishwakarma / AI Photo Prompts.
• You may copy individual prompts for your personal and lawful creative use.
• You may not scrape, bulk-download, or systematically copy the entire prompt library in order to create a competing website or service.
• Sample result images are provided only as visual examples. They do not grant you any rights to the likeness of any person who may appear in an example image.

4. Acceptable use
You agree to use the Service only for lawful purposes. You must not:

• Use prompts to create illegal content, hate speech, content that sexualizes minors, scams, fraud, or any material prohibited by Indian law or by the policies of Google, OpenAI, or other AI providers.
• Attempt to overload, disrupt, or harm the website or app.
• Use automated tools to scrape the full library without permission.
• Misrepresent the prompts as your own original work if you republish them commercially in a way that competes with this Service.

You are solely responsible for any content you generate using the prompts on third-party AI platforms.

5. No warranty
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that:

• The prompts will produce any particular result
• The website or app will be uninterrupted or error-free
• Sample images accurately represent every possible output

6. Limitation of liability
To the maximum extent permitted by law, Saurabh Vishwakarma and AI Photo Prompts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service or from images you generate with third-party tools. Our total liability for any claim related to the Service is limited to zero because the Service is free.

7. Advertising
The website may display third-party advertisements, including Google AdSense ads. We are not responsible for the content of those advertisements or for the practices of the advertisers.

8. Changes to the Service
We may add, edit, unpublish, or permanently remove any prompt at any time without notice. We may also change features, the design, or temporarily suspend the Service for maintenance.

9. Termination
We reserve the right to restrict or terminate access to the Service for anyone who violates these Terms or abuses the platform.

10. External links
The Service may contain links to third-party websites or apps (Google Gemini, ChatGPT, Google Play Store, etc.). We are not responsible for the content, privacy practices, or terms of those external sites.

11. Android application
The same Terms apply to the LotaMota AI Prompts Android app. Additional platform rules of the Google Play Store also apply when you download and use the app.

12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will be revised when changes are made. Continued use of the Service after an update constitutes acceptance of the new Terms.

13. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Varanasi, Uttar Pradesh, India.
